Accordingly, niania-top disclaims any responsibility for the content of published advertisements and/or services, meetings, or services that may result therefrom. If the user breaches his obligations under these terms and the law, the responsibility of the babysitter is expressly excluded. Niania-top reminds you that certain precautions should be taken during the Users’ physical meetings.

The niania-top advises its Users to always meet in public places in advance and inform nearby people about the place and time of the meeting. Niania-top also reminds that Users must independently carry out all the checks they deem necessary concerning the person they want to hire for the service. By using the niania-top, users undertake to comply with legal reporting obligations as an employer or as an employee. The conclusion of the contract, the legal declaration, and the provision of services are the sole responsibility of the Users. Should any of them prove to be defective, the responsibility of the niania-top is expressly excluded. Using and registering in niania-top means full acceptance of the above rules

The website is a social networking site designed to facilitate contact between people who share mutual needs relating to different categories of personal services. The Website does not guarantee the accuracy of the information provided, which was written under the full responsibility of the members. Following internet practices and customs, the Website may place advertisements and promotional or sponsored links. The brands on this website remain the property of their respective applicants.

The website is open to the public and free to all Users. Registration and profile creation is free. Subject to compliance with the terms of this agreement, the profiles and advertisements are posted without any financial compensation. Searching and viewing the content of profiles is free. Niania-top may be required to market additional services and options that enable the user to benefit from additional services. The prices quoted on the Site are inclusive of all taxes. They are denominated in Polish zlotys. These prices are subject to change at any time by the Company and are only valid on the date of subscription and have no effect on the future.

2. Your intellectual property

Niania-top does not acquire any proprietary rights to your content. The website may, in particular, offer other users the option of (i) viewing your content on the Website or from the Website using other electronic means of communication (in particular mobile phones) and (ii) downloading your content to other media. We also inform you that due to the inherent features of the Internet, the transmitted data, in particular content, is not protected against the risk of redirection and/or piracy, for which we cannot be held responsible.

3. Our Intellectual Property

The Website is our sole property. In general, we grant you a personal, non-exclusive, and non-transferable right to access and use the Site, with all other rights expressly excluded without our prior written consent.

4. Our Responsibility as Host

7.3 Nature of Use and Data

Niania-top is a private social networking site. Accordingly, members are not allowed to:

Use their ads for purposes other than highlighting a need or service by linking with childcare, child development, help for seniors, and home help. Use information from other members’ postings for purposes other than establishing a personal relationship to offer or disclose a service or need related to your condition. Accordingly, advertising, defamation, jokes, etc., are not allowed. Niania-top creates a contact e-mail address that allows each user to alert niania-top about uses that do not comply with the above-mentioned rules. As the host, the niania-top cannot be held responsible for non-compliance with these rules, and his liability is limited to the rules set out in article 4. Niania-top also reminds users that it reserves the right not to publish a profile or photo that it deems unethical on the Website, without having to make an excuse.

7.4 Prohibited Content

In the event of a breach of any of these obligations and without an exhaustive list, you acknowledge and agree that the babysitter will be able to refuse, unilaterally and without prior notice, access to all or part of the website.

7.6 Use of cookies

The User is informed that some of the Services require the installation of cookies. Cookies are small text files that are stored for a certain time in your computer’s RAM (these are called “session” cookies) or on your computer’s hard drive (these are “persistent” cookies). Cookies contain, among others, information on the User’s access to the relevant server so far, information on offers that he has read so far, or information on payment terms that have been agreed upon in previously performed transactions. The main purpose of cookies is to store specific information, on the one hand, by providing the User with a specific offer, and on the other hand, by creating the most convenient use of the Services. 7.7 Verification of Identity

Niania-top offers its members an identity verification service. The “verified identity” is mentioned on the profiles of members who subscribe to it and who pass the verification process:

• The member sends a copy of the ID document electronically.
• niania-top checks the consistency between the name, surname, and date of birth indicated in the profile and those in this identity document.
•  The document is not kept by the niania-top
• This check is a policy check. In no event does niania-top guarantee the identity of the person who created the profile. The following cases may arise, and are not exhaustive:
• a member has forged an identity document
• the member has created a profile for another person and sent an identity document that does not belong to him
• An error occurred while manually validating the uploaded document against the profile information.
• Under no circumstances may the babysitter be held responsible for the misappropriation of a member’s identity or a false declaration, even if a “verified identity” badge is assigned to the profile.

7.8 Internal Messages

Niania-top offers service instant messaging. Messages exchanged through this service can only be viewed by the sender, recipient, or members of the niania-top team. Members are informed under these terms of this service’s public and non-personal nature. Even if the messages cannot be read by other members in practice, under no circumstances can the niania-top be held responsible for anyone’s access to these messages. In addition, members are informed that the niania-top team may be asked to read exchanged messages, in particular for the purposes of:

• user satisfaction verification
• verification of the proper use of the website by users
• or for any other reason left to the discretion of the highest niania team

Users who do not have an active pass are not authorized to send their phone number or e-mail via messenger or encourage the correspondent to contact them by any means other than via the website. Any breach may result in damages owed by the niania-top user. niania-top reserves the right to block the user’s account, the behavior of which is not considered appropriate or following the General Terms and Conditions of Use after reading messages exchanged through this service.

7.10 Right to withdraw from the contract

As such, no revocation, or cancellation, will be accepted for more than seven days. Nevertheless, at the discretion of niania-top team, a commercial gesture may be made.

7.11 Services fees to be paid:

We do love helping people as a Team; therefore, we set the best prices for each service in the whole Polish market as described below,

1. Taking care of Childen on behalf of a nanny or babysitter.

2. Children’s development.

3. Home, and garden support request.

4. Taking care of elderly people.

8. Website Availability

The Website is generally available 24 hours a day, 7 days a week, except for interruptions, scheduled or not, for maintenance or in the event of force majeure. While obligated to have the appropriate resources, we cannot be held liable for any damages, whatever their nature, arising from the unavailability of the Website.

9. Proof, conservation, and archiving

Computerized records kept in our systems following the principles of the art of security will be treated as evidence of electronic communication, sending registration forms, uploading and downloading content (texts, photos, and videos). Registration forms are archived on a medium that can ensure the fidelity and durability required by applicable regulations. It has been agreed that in the event of a discrepancy between our computerized records and your documents in paper or electronic format, our computer records shall take precedence.

10. Compensation

You agree to indemnify Niania-top, its subsidiaries, and affiliates, and their officers, agents, partners, and employees against any loss, liability, claims, including all reasonable attorney’s fees, by third parties, caused or resulting from use of the Website in breach of this Agreement and/or resulting from any breach of this Agreement and/or from any breach of your representations and warranties set out above and/or if any Content you post on the Website causes Niania-top to be liable to other persons, insofar as such responsibility is attributed to the reprehensible conduct.

11. Governing Law and Assignment of Jurisdiction

Bearing in mind the international dimension of the internet network, niania-top reminds you that you must comply with all mandatory regulations and public order in Poland. In the event of a dispute arising from the performance, termination, or terms of this contract, the parties will endeavor to settle the dispute amicably.

12. Miscellaneous

If any part of the General Terms and Conditions is found to be illegal, void, or unenforceable for any reason, the conditions in question will be deemed non-existent, and the remaining terms will remain in full force and scope and will continue to apply. The non-existent conditions will be replaced with one (of) those that are closer to the content of the canceled clause.
